1. Agreement to Terms

By engaging POUD INFRSTRUCTURES PRIVATE LIMITED for construction services or digital marketing solutions, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the "Client") and POUD INFRSTRUCTURES PRIVATE LIMITED (the "Company").

If you do not agree to these terms, please do not engage our services. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting.

2. Services Provided

POUD INFRSTRUCTURES PRIVATE LIMITED provides comprehensive construction and infrastructure development services, including but not limited to:

• Building construction (residential, commercial, industrial)
• Civil engineering and infrastructure development
• Project management and consulting services
• Digital marketing and online presence solutions

All services are provided subject to the terms and conditions outlined in individual project contracts and these general terms of service.

3. Project Contracts and Specifications

Each construction or digital marketing project will be governed by a separate written contract that includes specific terms, deliverables, timelines, and payment schedules. The project contract will take precedence over these general terms for project-specific matters.

All work will be performed in accordance with:

• Approved project specifications and drawings
• Applicable building codes and regulations
• Industry standards and best practices
• Environmental and safety requirements

4. Payment Terms

Payment terms will be specified in individual project contracts. Generally, our payment structure includes:

• Initial advance payment upon contract signing
• Progress payments based on project milestones
• Final payment upon project completion and acceptance
• Late payment charges as specified in the contract

All payments are due within the timeframe specified in the project contract. Failure to make timely payments may result in work suspension and additional charges.

5. Client Responsibilities

Clients are responsible for:

• Providing accurate project requirements and specifications
• Obtaining necessary permits and approvals
• Providing site access and utilities as required
• Making timely decisions and approvals
• Ensuring clear communication throughout the project

6. Quality Assurance and Warranties

We provide quality assurance for all our construction and digital marketing services:

• Construction work warranty as per industry standards
• Defect liability period as specified in contracts
• Quality control and inspection processes
• Compliance with approved specifications

Warranty terms and conditions will be detailed in individual project contracts and may vary based on the type and scope of work performed.

7. Limitation of Liability

POUD INFRSTRUCTURES PRIVATE LIMITED's liability is limited to the contract value of the specific project. We shall not be liable for:

• Indirect, consequential, or punitive damages
• Delays caused by factors beyond our control
• Changes in regulations or permit requirements
• Acts of nature, force majeure events

8. Intellectual Property

All designs, plans, digital marketing materials, and other intellectual property created by POUD INFRSTRUCTURES PRIVATE LIMITED remain our property until full payment is received. Upon full payment:

• Clients receive usage rights for the intended purpose
• We retain the right to use work for portfolio purposes
• Third-party materials remain property of respective owners

9. Termination

Either party may terminate the agreement under the following conditions:

• Material breach of contract terms
• Non-payment of dues as per contract
• Mutual agreement between parties
• Written notice as specified in the contract

Upon termination, payment will be due for all work completed up to the termination date, and any materials or equipment purchased for the project.

10. Dispute Resolution

Any disputes arising from our services will be resolved through:

• Initial attempt at amicable resolution
• Mediation through recognized industry bodies
• Arbitration under Indian Arbitration Act
• Jurisdiction: Courts in Karnal, Haryana

11. Governing Law

These terms of service are governed by the laws of India. Any legal proceedings will be subject to the jurisdiction of the courts in Karnal, Haryana. The contract language is English, and any translations are for convenience only.
